To loyal English subjects this system seemed quite fair. It avoided the excesses of despotic rule while also ensuring that the ignoble peasants were kept in line. Even more, an ambitious commoner might even rise to a position of wealth and moderate prominence – though he would also be less than a nobleman. Examples of British subjects who attained these levels are George Washin gton, Benjamin Franklin and Thomas Jefferson, who would later be the chief architects of the American Revolution. For many in the American colonies, however, good old British rule was a silly anachronism that had to be swept away, so that the rightful rulers of society, the people themselves, could truly self govern. One of the most vocal and articulate of these libertines was Thomas Paine. Paine’s Common Sense was more than a political tract. it was in itself a revolutionary way of seeking political change. As mentioned before, the idea that the common person was qualified to judge matters of state was generally considered ludicrous. The established view was that people of superior breeding, with titles and possessing all the benefits of classical education, were the only ones who were competent to judge matters pertaining to a nation as a whole. Paine spoke directly against this view, calling the British monarchy a corrupt institution that governed poorly, oppressed the pop ulace and lived parasitically off of the fruit of other’s labors while producing little of value. In one section he says this most plainly: In England a king hath little more to do than to make war and give away places; which in plain terms, is to impoverish the nation and set it together by the ears. A pretty business indeed for a man to be allowed eight hundred thousand sterling a year for, and worshipped into the bargain! Of more worth is one honest man to society and in the sight of God, than all the crowned ruffians that ever lived. Paine advocated nothing less than the dissolution of the monarchy, to be replaced with a congress of representatives that would be directly elected by the people and directly accountable to them for their governing decisions. The congress would have a president that it would elect, and any legislation that became law would require a 60% majority of votes. The truly radical thing about Common Sense was not only the ideas it proposed but the wa y it which it did so. Prior to its publication political treatises were written by men of letters, and made copious references to medieval and Renaissance academics, renowned philosophers and scholars known only to the highly educated. This is the reason why educational institutions are investing well for the development of athletic departments that are expected to help their students become better academic performers. Maggie is the very shy and polite one out of her and Dee. Maggie was the character that lived with mama, during the story it says that Maggie was burned in a house fire. This character is a character that would just blend into the background because of how shy she was, she wouldn’t talk to much; so she would rather just blend in with the surroundings. Maggie was a foil character because her and mama didnt change nothing throughout the six years that passed, while Dee did change a lot; throughout those six years. Maggie is a good hearted kid, she would rather let Dee have the quilts that were promised to her, instead of fighting over them. Dee is sisters with Maggie in this story, she is the character who is very impolite, or that does things her way. Dee is the only educated character; it says in the short story that she left so that she could be educated. Dee is noticed as a character that does whatever she wants, and have it go her way. One example is that, Dee wears a brightly colored, yellow-and-orange, ankle-length dress that is inappropriate for the warm weather. This shows that she would wear anything she wants even if its inappropriate in any way. In the story mama wouldn’t let Dee have the quilts, and she became furious. This another example that she is very stubborn, because in the end she keeps the quilts. In this story i learned that being generous and polite will get you farther in life, but if you’re stubborn, and impolite you won’t get as far in life.

Dispute Resolution Processes Essay -- Legal Process

Introduction This paper will examine when it is appropriate to attempt alternative dispute resolution (ADR) processes for disputes and conversely when it is fitting for matters to be decided in a courtroom with black-robed judges and well dressed lawyers. Complementing the correct ‘intervention [courtroom, facilitative ADR or another form of ADR] at the right time, price and place with the right disputants’ is not necessarily an easy task (Wade 2010, p. 13) and the line separating alternative dispute resolution processes and judicial intervention can be blurred especially as judicial officers conduct, refer or mandate parties to participate in ADR (Sourdin, 2009, p. 190). Proof that fine panelled courtrooms may not be the answer to dispute settlement is the move towards the ‘mandatory’ use of alternative methods prior to hearings (Ardagh and Cumes, 2007, p. 206). Do most people with problems want pain relief quickly and inexpensively? Yes most people in pain want relief quickly and inexpensively but they often want other things too. They want to be heard, they want to heal the hurt and they want a ‘satisfactory [and]†¦ enduring’ outcome (Moore, 2004, p. 2). They also want to change from having ‘a destructive interaction to a constructive one’ (Ardagh, 1999, as cited by Spencer and Hardy, 2009, p. 165). There are differing views about the suitability of facilitative ADR approaches for various types of conflict. Some believe that this type of ADR is more appropriate for addressing ‘interest disputes than rights disputes’ (Boulle & Nesic, 2001 as cited by Van Gramberg, 2006, p. 121).
